Middlesex Ss. January 13th. 1734.   The Commissioners appointed to Distribute & Settle the Real Estate of Nathll. Whitney Senr. late of Weston in the County of Middlesex Dece'd Intestate - having made Return of their Doing therein ~ The Heirs of the Sd. Dece'd this Day appear'd (by my citation) to the End that the Said Estate might be Setled according to Law -- and the Return of the Said Commissrs. being read -- 'twas mov'd by mr. Joseph Harrington (who married ) that the 14 acres of Land in Weston, mentioned in Said Return as given by the Said Dece'd to his Son Nathl. Whitney & by the Said Commissioners valued at ninety one Pounds -- ought not to be Consider'd as so much advanced to the Sd. Nathaniel in part of his Portion - by reason of a certain blank in the Deed of Sd. Land -- implying (as he Supposes) that it was the Intention of the Dece'd that Sd. Nathl. Should not be accountable therefor when his (the Sd. 13 Feb 1838, Stephen Whitney petitioned the court, declining to be guardian of the children of his brother Timothy Whitney deceased, and he desired that Mr. Otis Trowbridge be so appointed.

On 17 Feb 1838, Otis Trowbridge of Newton, yeoman, as principal, and Ephraim Jackson of Newton, yeoman, and Elisha Hyde of Needham, as sureties, posted bond as guardian of Elisha Whitney and Sarah Whitney, minors under the age of fourteen and children of Timothy Whitney late of said Newton, deceased.

20 Mar 1838, petition of Otis Trowbridge, guardian of Elisha Whitney and Sarah Whitney, minor children of Timothy Whitney, late of Newton, deceased, concerning Timothy's real estate. It consisted of about 27 acres of land in the south part of Newton, a town road passing through the same, with an old house and barn thereon. The buildings required very extensive repairs, and that said minors do not have sufficient personal property for that purchase. Thus Otis Trowbridge asked that the property be sold and the proceeds divided between them. The sale was ordered on 15 May 1838. Notice of the sale was posted in local newspapers, ending on 9 Mar 1839, and the land was sold 21 May 1839, to William H. Sumner, for $800.
