Geo[rge] Whytney & Thomas Myll gen[erosus] v[ersus] Eustace Whytney esq[uire] and Ric[hard] Bullock def[endan]ts
Whereas by an order made on Wednesday last the pl[aintif]s need to showe cause this day wherefore they should not bringe into this Courte all such arrerages of Rent as heeretofore grewe ____ for the Landes in varyence in the bill mencioned ever synce the pl[aintif]s enjoyed the same by reason of the estate? by devyse under w[hi]ch the said Geo[rge] Whytney claymethe and held all such Rente as heereafter shall _____ _____ all the hearings of the cause & _____ Rent weere? by that estate to be payed as by the said order append__ Forasmuch as this Courte was this p[re]sent day informed by Mr Tanfyeld beinge of the pl[aintif]s Counsell that the yeerely Rent ys C Markes and that the def[endan]t Ewstace claymeth vj or vij yeeres arrerages thereof w[hi]ch can not be brought in on the said day__ and further informed that Ewstace Whytney may the better _______ the same in Respect he oweth to the said Tho[mas] Mill above CC li w[hi]ch by his dyrection or appoyntment the said Tho[mas] loyd owt for blacks? for the funeralls of Sir James Whytney knight deceassed and also ought to Answere and pay to him the said Tho[mas] Myll CC nowe for A legacy dewe to the wyef of the said Thomas Myll by the last will and testam[en]t of the said Sir James w[hi]ch legacy omungst other things to the said Ewstace in consyderac[i]on that George Whytney nowe deceassed and one Wm Whytney two of the executors of the said Sir James delyvered unto him the possessyon of the goodes of the saide Sir James agreed and undertoke to pay It is therefore ordered that yf the pl[aintifs] shall borowe bonnd or to this courte by Recogniz[ance] in a Competent some w[i]th suffycient Sewertyes to abyde the order of this Court upon the hearinge towchinge the said Rent & arrerages Then the said pl[aintifs] shall not be compelled to bringe the said Rent of 100 Markes by yeere and arrerages thereof into this Court untill the Cause shalbe heard and fynally Determyned by this Courte./
