Uppon the opening of the matter in varyance depending in the Queenes ma[jes]t[es] hono[u]rable Court of Requests, Betweene Thomas Whitney gent compl[ainant] and Evan lloyd and will[ia]m Watkin Lewes def[endan]t[es], concerning among other thing[es], the stay of the proceeding of the def[endan]t[es] or of one of them, in an Acc[i]on of debt by them or one of them com[m]ensed at the com[m]on Lawe in an acc[i]on of debte, by them or one of them com[m]ensed at the Com[m]on Lawe uppon an Obligac[i]on, Wherein the same pl[aintiff] and others as his suerties stand bonnde ioyntly & sev[er]ally unto the def[endan]t[es] or to one of them in the some of three hundreth pound[es] w[i]th Condic[i]on for p[er]formance of certen Coven[a]nt[es] contained in A paire of Indentures made betweene the said pl[aintiff] and the sayd Evan lloyd one of the saide def[endan]t[es] w[i]th Indenture the said pl[aintiff] by his Bill of complainte alledgeth to be made by the same pl[aintiff] to the said Evan lloyd uppon A speciall trust in him reposed by the said pl[aintiff] and yet the same estate and assurance meant to be to the use of the said will[ia]m watkin Lewes thother def[endan]t, And that at then sealing of the said Indenture and Bond Obligatory the sayd Evan lloyd in Considerac[i]on thereof promised and argreed to and w[i]th the said pl[aintiff] that the saide Will[ia]m Watkin Lewys should become bounde likewise unto the said pl[aintiff] in the like Som[m]e of three hundreth pound[es] w[i]th Condic[i]on to surcease from p[ro]secutinge of appeale, sute or Inditement against the said pl[aintiff] for the death of one hoell watkins, brother of the said will[ia]m watkin lewes, and for the doing & p[er]formance of sundry other thing[es] then agreed uppon As by the said Bill more at large is sett forth and alledged, Unto w[i]th Bill the said def[endan]t[es] have appeared & made their Aunswere And thereuppon by Order of this said Court & at the moc[i]on of Mr Wynter being of counsaill w[i]th the compl[ainant] the xxjth of Octob[e]r last, the same Mr wynter then alledging that the said assurance of the Land[es] aforesaid was passed onely for & in considerac[i]on of concealing & compounding of & for A supposed murther of the said will[ia]m Watkins brother, w[hi]ch is plainely confessed by the def[endan]t[es] Aunswere, And for that yt was by the said Mr wynter alledged, that div[er]se bad practises were used by the def[endan]t will[ia]m watkin against the pl[aintiff], aswell in proceeding w[i]th an Inditement of murther contrary to his form[er] promise & thereby putting the pl[aintiff] to hazard of his lief As also by refusing to enter into Bond accordinge to the faithfull promise of the sayd Evan lloyd, Whereuppon the said pl[aintiff][es] Counsayle prayed to ____ an Iniunction, for the stay of the sute at the com[m]on lawe com[m]ensed against the pl[aintiff] uppon the said bonde, At w[hi]ch time day was given that both the p[ar]ties w[i]th their counsayll should attend uppon friday then nexte to understand the Court[es] pleasure towching the grauntinge of that Iniuncc[i]on At w[hi]ch day the said Compl[ainant] w[i]th his said counsaill attended and the def[endan]t[es] made default, And thereuppon yt was then by
