Brooke Whitney In the name of the father and of sonne and of the holie Ghost Amen I Brooke Whitney of longe hanborough in the Countie of Oxford beinge weake in bodie but of pfect memory I thanke the lord to whom only oure tymes are knowen this seaven and twentith daie of July Annon Domini 1624 doe endevor to sett downe this my last will and testament and doe renounce all former wills. First I committ my soule into the handes of almighty god trusting only in the merrites of my lord and saviour Jesus Christ for the salvation thereof my bodie I leave to the disposinge of my executor and x s to mr Forde to him two sale[?] of my bootes I devise xx s in money and bread to be distributed at funerall amongst the poore inhabitante by the assistance of the Churchwardens Item I devise xi s to the Stocke of the poore of hanborough and for the better and more spedier paiment of my debtes and legacies herein bequeathed I doe devise not only all my goodes and Chattels parsonals but also the issues rentes and proffits of my landes tenements and heredetamentes at Hanborough aforesaid and at North Mymes in the Cownty of Herts and of the farme called yarkes in weasthagborne in the Cownty of Berk except the Roomes behinde the hall Chimny and such parsells as Walter my sonne hath enjoyed for many yeares past by my apointment unto my sonne in lawe William Terrold for and during the full tearme of sixe yeares next after my decease whom I make my sole executor trusting he will performe in the feare of god booth speedelie and consideratly accordinge to the truste I repose in him I devise to my sonne Henry fiftye powndes to be paied within one yeare after my decease Item Joana my daughter xxx s to be paied within two yeares after my decease or soner it maye be Item to my sonne Jeffery tenne powndes within 4 yeares Item to my sonne Samuell xxx if he returne to inhabitt in london Item from and after the xpiration of the saide sixe yeares I devise my landes and tenements and hereditament at hanborough unto my sonne Brooke and to his heires Item after the saide sixe yeares I devise all my landes tenemente and hereditament in Mymes to the said Gefferye and Henry my sonnes and to there heires Item if walter shall fortunne to outlive the saide fowre yeares of the sixe then I devise the whole residence of the estate therein to my saide executor and to the saide walter joyntly Item I devise him fortie shillings and would not have him Chardged with any bonde debt or covenant due by him to me except hereoffe and molest or interrupt my executor or the performance of this my will for then I will that he take noe benifitt hereby Item to my Cosen Charles Evans xx s and to my maide anoble and to my daughters each a Ringe of x s and soe to my brother Rondle and to every grandchild I have x livinge at my decease and soe much to my sister Isabell and for any bondes or bills of sister or Cosen I wishe they paie halfe and remitt the rest and if after debtes and legacies discharged any overplus shall happ I wishe a distribution were amongst my posterity my executors shall see most need devisinge to my saide executor x s and xx p to the worshipp of my lovinge frende Thomas Templeton Esquier whom I requested to be and advisinge overseer as occasions maye require In witnes whereof I have hereunto sett my hand and seale the day and year first XXXX written By me Brooke Whitney These beinge witnesses Signum Richard Diffenden Thomas Hartles Signum William Hirchman This will was perused and published by the testator beinge of perfect memory prayed be god the vijth daye of october and allowed and confirmed by him then Ano Domini 1624 in the presence of Richard Tyrold his marke anthony feild & alia Probatum fuit testamentum suprascriptum apud london coram venerabli viro Duo Henrico Marten milite legum doctore Curie prerogative Cantuariensis Magro Custode sive Commissario legitime Constatuto Decimo Sexto die mensis novembris Anno Domini Millesimo Sexcentesimo viresimo quarto Inramento Willim Tyrrold executoris in huiusmodi testamento nominati Cui Commissa fuit Administratio bonorum jurium et creditorum dicti defuncti De bene et fideliter administrando eadem Ad sancta dei Evangelia Jurat
Translation:
- The above-written will was proved in London in the presence of the Honorable Henry Marten, Knight, Doctor of Law, and Master Keeper or Commissary of the Prerogative Court of Canterbury, duly constituted on the 16th day of the month of November, 1624 by the oath of William Tyrrold, named executor of this will, who was granted administration of all and each goods, property, and credits of the said deceased, who took an oath on the sacred gospels to faithfully administer the same.
