DEED INDENTED witnessing that Eustace de Whitney, lord of Whitney has at the request of Sir Roger de Whitney, Philip de Pencombe, William de Kekenwyche, William de Almaly and others granted to the commoners and landowners of Clifford, for a sum of money paid to him, licence to pasture their animals on land belonging to him called la brome (Norman-French) 2. 4. 1424/5. DUPLICATE of No. 3. 5. 1470. Nov.4. WRIT OF HABERE FACIAS SEISANAM to give possession to Eustace de Whyteney and Elizabeth his wife, of the Manor of Whyteney, being cognizees in a Fine levied between them and Roger de Whyteney, parson of the Church of Pencombe.

Note: Individuals named "Eustace de Whyteney" and "Roger de Whyteney" have not been found in the year 1470. Also, the "de" prefix was dropped from the surname about 1375 - one hundred years earlier than this document was supposedly dated. We believe that for these reasons (the individuals named and the form of the surname used) that this document has been dated incorrectly in this catalogue. In 1277, Eustacius de Whitney was patron of Pencombe; in 1280 Roger de Whitney was incumbant in Pencombe; about 1280, Eustace de Wytteneye, Knight, confirmed land granted by his ancestors to St. Peter's Church; in 1301 Eustace de Wyteneye entered into an agreement regarding his marriage to Elizabeth, dau of Sir Alexander de Frevylle and lady Joan de Friville. The names in this document appear to date from this time period rather than from 1470. The date in the index, 4 Nov 1470, is in the 10th year of the reign of Edward IV. If we instead consider the 10th year of the reign of Edward I, we get 4 Nov 1282, which fits the time period in which we know individuals with these names were living.
