"Davenport Iowa Feb 21
Sir
I have rec. the notice of the sudden death of my husband L. H. Whitney of Sunderland Mass. We were married the 16th of Aug 1869 and I lived with him some more than eleven years, and they might have been happy years only for his cruel jealous disposition which made him at times almost a maniac. He was constantly accusing me of infidelity to him and he treated me so cruelly that I felt forced for the safety of my life to leave him and in Nov 1880 I told him I must leave and he consented and gave me a small share of his property one thousand doll in money and we went before a justice and signed papers that neither of us should claim the others property. The household goods he gave me my chamber set and reserved all the rest to himself, som of which I paid for, but he said it should be then be removed but when he sold the place I should have some of it. Now I am not much versed in matters pertaining to law but a few years ago he went before you and made his will and was about to include in my portion the household goods, and you then told him the household goos belonged to his wife and that he could not will them otherwise. I now petition you when the court comes on to give me his true and faithful wife the household goods. I supposed there was a will now but it seems that it has been destroyed. He leaves no children, only sisters and one half brother for heirs and no one of them needs the goods as much as I do and I do not think one of them will object to my having them. If aught else rightfully belongs to me I of course shall gratefully accept it. I am in Davenport Iowa 128 Mound St. for a few weeks but if necessary or business requires can return on short notice to Mass. but Henry Sheldon of Southampton Mass. holds all my papers and will attend to all business if address there, as to me here please do all you can for me. Delcena M. Whitney"
30 Nov 1880, agreement between Lyman H. Whitney and Delcena M. Whitney, as above described.
